No Ruling in AB&C Case: Workers Will Have to Wait

Former employees of AB&C Group Inc. will have to wait to find out whether or not they will be paid for their last weeks of work with the company.A judge said Thursday afternoon the court would adjourn until June 24th when attorneys would submit briefs about their cases for his review.Thursday’s case revolved around a motion filed by Martinsburg Attorney Kathy Santa Barbara to authorize payment of wages to employees.  She maintains that $345,000 was advanced to BB&T from Sovereign Bank that was designated as a trust to be used for compensating employees.Appointed trustee in the AB&C bankruptcy case Robert Trumble said a trust was never clearly established and so the money could be used at the trustee’s discretion.  Trumble said the wages for employees are fourth on the priority list in a bankruptcy case, and the money needs to be used to pay professionals such as accountants and computer people to return money to creditors by liquidation of assets and collection of money owed.Indications were made that the failure of AB&C group may have been foreseen over a year ago, but those issues will be directly addressed in a related case.  For now, the judge will await the briefs from both attorneys before making a ruling which he said may come via the internet or a phone call as he will not be back in Martinsburg until July 31st.  He hopes to have a ruling before that time.
