Surber Back in West Virginia

Donald Berkeley Surber Junior is back in West Virginia after waving extradition yesterday… he was taken back to Eastern Regional Jail by Berkeley County Sheriff’s Deputies yesterday afternoon.  The 37-year-old Winchester man is charged with the kidnapping and murder in the stabbing death of his 35-year-old ex-girlfriend Katherine Nicole Sharp during a 26-hour standoff with police earlier this month.

Surber was in Virginia being treated from a gunshot wound stemming from an escape attempt last week.  Berkeley County Prosecuting Attorney Pamela Games-Neely said earlier in the week she thought Surber might fight extradition so her office was prepared to either way with a governor’s warrant.

Surber is due in Berkeley County Magistrate court at 11:30 Thursday morning to be arraigned on the kidnapping and first degree murder charges, but Games Neely said that as of Wednesday, he had not retained legal council.  He was arraigned Wednesday afternoon on video for the escape charge.
